Some national data-protection bodies have also drawn up guidelines or public consultations on cloud computing. ![]() Neelie Kroes, the European commissioner for the digital agenda, is preparing a strategy on cloud computing to address issues of security, privacy, portability and accessibility. Peter Hustinx, the European data protection supervisor, has also made cloud computing a priority area for his agency’s work this year. Viviane Reding, the European commissioner for justice, fundamental rights and citizenship, has included cloud services in her proposal for a data-protection directive, adopted by the Commission in January.Ĭompanies who do business with European consumers, Reding has said, have to follow EU data-protection rules, be they social networks, cloud providers or any other type of service. This lack of clarity has prompted the Commission to take action. In December, BAe Systems, a British-based defence firm, announced that it had dropped plans to use Microsoft’s Office 365 – a cloud version of the company’s popular Office application suite – after Microsoft was unable to guarantee that the data would not leave the EU.Ĭloud computing also raises concerns about the law applicable in cases where a data centre, its parent company and the customer may be in different jurisdictions, inside or outside the EU.Ī clear majority – 63% – of respondents to a public consultation by the European Commission’s department for information society and media last year thought that rights and responsibilities, notably issues of liability, were unclear in cross-border situations. ![]()
